Court In Abia Remands 40 Yrs Uncle For Defiling His 13 Yrs Nice

The magistrate court in Umuahia has remanded one 40 years old school proprietor Okwubunka Nwaosueke to Afara correctional centre Umuahia for allegedly defiling his 13 years old nice Miss Oluchi Nwaosueke
The charge sheet No U/4144/2020, read, Commissioner of Police Versus Okwubunka Nwaoseke male 40 years.
“That you Okwubunka Nwaoseke male sometime in the month of May, 2020, at Umumba Nsirimo Ubakala in Umuahia South Magisterial District did have unlawful carnal knowledge of one Miss Oluchi Nwaoseke female, age 13 years old and there by committed an offence punishable under section 218 of the criminal code cap. Vol.3 of laws of the Abia state, 2005”.
Speaking the defence counsel Barr Uwakwe pleaded with the court to grant his client Okwubunka bail adding that the suspect has no previous criminal record.
He urged the court to exercise the discretion in favour of his client and grant him bail pointing that his client has a reasonable surety to take him on bail
He maintained that it is the constitutional right of his client to be granted bail.
Speaking also the prosecutor, Glory Ekenam urged the court not to heed to the call to grant the suspect bail.
She disclosed that the suspect is a serial defiler of minors adding that they have record of series of cases of girls who said he has defiled them.
She said of recent they have been receiving cases of rape in Umuahia and environs and that the raped girl Oluchi Nwaoseke is just 13 years and people like the suspected rapist be taught a lesson so that it serve as a deterrent to others. She reminded that rape case is a serious case that attract life imprisonment in Nigeria pointing that Okwubunka should not be granted bail
Ekenam maintained that Okwubunka has been a threat to his entire family members ever since the rape case happened that instead of seeking for peace have continued to issue threat to family members and the community who is against his action.
The prosecutor reiterated that instead of the alleged rapist to show remorse and appealed to his family for forgiveness rather turned around to arrest the alleged raped girls mother mrs Daberechi Nwosueke adding that his action infuriated the youths of the community who put up a search on him found him and handed him over to the police who has been in the look out for him.
Responding the presiding magistrate Emmanuel U. Nwankpa said the issue of consideration of bail is reserved and would not grant the suspect bail.
He disclosed that he would not act in haste but will look at the position of the law, he therefore remanded the suspect to Afara correctional centre, Umuahia and adjourned the case till the 14 of August 2020.
In an interview with the defiled victim, Oluchi Nwaoseke said the suspect who is his uncle and the proprietor of the school she attend harassed her five times at different occasions at the house and school, she said it was the fifth time that he actually penetrated her.
When asked why she kept quite and not report to her parent, said the uncle at different occasions threatened to kill her if she open her mouth to talk.
“I was always been threatened with death and i was scared, I try to avoid him but because we leave in the same compound it was difficult for me, he will always target when my parents are not around to harassed me sexually ” Oluchi said.
Oluchi said she finally opened up at the last count after the uncle penetrated her, “i started having bleeding and waste pains and anytime i went to urinate i feel unbearable pains, my mother also noticed my pains, she asked me of what happened and I opened up”.
