Appeal Court reverses judgment sacking Adeleke as Osun State Governor

The Court of Appeal sitting in Abuja has reversed the January 27 judgement of the Election Petition Tribunal, Oshogbo, sacking Ademola Adeleke of the Peoples Democratic Party (PDP) as Governor of Osun State.

The Tribunal on had also directed the withdrawal of the certificate of return issued to Adeleke and ordered that it should be issued to the Adegboyega Oyetola of the All Progressives Congress (APC)

However, the Appellate Court on Friday held that the appeal, filed by Adeleke, his party and the Independent National Electoral Commission (INEC), against his sack, “is Meritorious”.

Delivering the Lead Judgement on behalf of the 3-Man panel of the Appellate court, Justice Mohammed Shuaibu held that the tribunal was wrong to reach the conclusion on over-voting

Justice Shuaibu held that “the appeal is hereby allowed” therefore setting aside the judgement by the election petition tribunal.

The court subsequently awarded the sum of 500,000 naira to the Appellant, to be paid by the 1st and 2nd respondents.
